The alleged “South Mountain Shooter” will walk out of the Maricopa County Lower Buckeye Jail within the next 24 hours. Superior Court Commissioner Phemonia Miller heard arguments this morning from defense attorney Marci Kratter highlighting Smith’s educational accomplishments, no prior criminal record, and strong family ties. Smith’s mother and brother also took the stand on behalf of Smith. The prosecution objected to lowering the bond, but the judge ruled in favor of the defense.

“I could tell the judge had sympathy for my case,” Smith said. “In my heart of hearts I know I did the wrong thing, but I was forced to defend myself because my life was threatened.”

Smith’s bond was lowered from $200,000 cash to $16,000 secured, and he must comply with pre-trial service stipulations, including an ankle monitor and house arrest. Smith was arrested on July 24 after he was attacked by two men at South Mountain Community College, both of whom were convicted earlier this year for breaking Smith’s jaw in December of 2007. Smith fired a handgun after one of the men punched him in the face, hitting the attacker and two bystanders. He faces 12 counts of endangerment and three counts of aggravated assault, a Class 3 felony. A status conference is scheduled for Dec. 1. Smith smiled as the judge read his release conditions, but knows there is still much work to be done.

“I don’t know what’s going to happen next man,” he said. “I’m just happy to be going home for the time being.”

    That is good to hear. I use to work with Rodney back in 2006 and he was always a cool humble guy. I pray for you bro and i wish you the best. When i heard about the incident i was like no way they got the wrong guy. but im glad that your going home. and it s not about what everyone is gonna think about you. Keep GOD first and he’ll take care of ya!!!
